On October 26, 2022, Mumia Abu-Jamal had a court date to determine if he would be permitted to present boxes of recently uncovered information hidden by the prosecution from his original trial. At this court date, Common Pleas Court Judge Lucretia Clemons denied Mumia his constitutional right to present this information.

This information documented (1) key witnesses receiving promises of money for their testimony and (2) evidence of favorable treatment in pending criminal cases. The information also documented the abhorrent and unconstitutional practice of (3) striking Black jurors during Mumia’s original trial. Judge Clemons is giving both Mumia and the prosecution one month to respond back to her rulings, and they return to court on December 16, 2022.
Judge Clemons acknowledged that her ruling contradicts the Constitution of the United States and therefore would be successfully overturned when Mumia’s appeals reach the Federal level, but that she was strictly ruling according to the “laws of Pennsylvania.” She did not mention that Mumia’s life expectancy may be as long as the glacial pace of Pennsylvania courts. Protestors call this “Death by Incarceration” and Judge Clemons is the latest to embrace this racist judicial tradition.
On Friday, December 16th there are buses from New York City and elsewhere to Philadelphia for this critical court date for Mr. Abu-Jamal.
